1. Who this agreement is with
TestSetGo is operated by Version Zero Limited, a company registered in England and Wales. In these terms, “we”, “us” and “Version Zero” mean Version Zero Limited. “You” means the person or organisation that opens a workspace.
By creating an account, opening a workspace or using the service, you accept these terms. If you accept them for an organisation, you confirm you are authorised to bind that organisation.
2. The service
TestSetGo turns material into a test, shares that test by link, code or invitation, and reports how participants performed. We may change, add or remove features. If a change materially reduces a feature you pay for, we will give reasonable notice and you may cancel under section 8.
Some features use automated question generation. Generated questions are a starting point and are shown to you for review before publication. You are responsible for checking that a test is accurate and fit for its purpose before you share it.
3. Accounts and workspaces
You must give accurate account information and keep your credentials secure. You are responsible for everything done through your workspace, including by members you invite. Tell us promptly if you believe an account has been compromised.
Participants ordinarily do not hold accounts. They enter a test through a link, code or invitation. You remain responsible for who you invite and for the lawful basis on which you collect their information.
4. Plans, payment and usage
Paid plans are billed in advance, monthly or annually, at the price shown when you subscribe. Plans include a response allowance and, where stated, seats. Response packs are one-off purchases valid for twelve months from purchase.
Fees exclude tax unless stated. Where we are required to charge VAT or sales tax, it is added at checkout. Payments are handled by our payment processor; we do not store your card details.
If a payment fails we may retry it and may suspend paid features until payment succeeds. Suspension never interrupts an assessment already in progress.
5. Your content
You keep all rights in the material you upload, the tests you create and the results your workspace collects. You grant us only the licence needed to host, process, back up and display that content so we can operate the service for you.
You confirm that you have the rights needed for material you upload, and that using it in TestSetGo does not infringe anyone else’s rights or breach a duty of confidence.
We do not sell your content. We do not use participant answers to train publicly-available models.
6. Acceptable use
Your use must follow our Acceptable Use Policy, which forms part of this agreement. In short: do not use TestSetGo to break the law, infringe rights, attack the service, or collect information you have no lawful basis to collect.
We may suspend or remove content, or suspend a workspace, where we reasonably believe it breaches that policy or exposes participants or us to legal risk. Except in urgent cases we will tell you first and give you a chance to fix the problem.
7. Data protection
For participant identity, answers and results, you are normally the data controller and we are your processor. Our Data Processing Agreement governs that processing and forms part of this agreement. Our Privacy Notice explains what we do with the information we control in our own right, such as creator accounts and billing records.
8. Term, cancellation and termination
You may cancel at any time. Cancellation takes effect at the end of the period you have paid for; your paid allowance stays available until then. We do not refund part-used periods except where the law requires it.
We may terminate this agreement on reasonable notice, or immediately for a serious or repeated breach of section 6. On termination you may export your results for 30 days, after which we may delete your workspace.
9. Availability and support
We work to keep TestSetGo available and to protect your data, but we do not guarantee uninterrupted service. Planned maintenance is scheduled to avoid disruption where practical. We do not offer a contractual uptime commitment unless one is agreed separately in writing.
10. Warranties and liability
The service is provided as described on our website. To the extent permitted by law, we exclude implied warranties of merchantability and fitness for a particular purpose.
Nothing in this agreement limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.
Subject to that, neither party is liable for indirect or consequential loss, loss of profit, loss of goodwill or loss of anticipated savings. Our total liability arising out of or in connection with this agreement in any twelve-month period is limited to the fees you paid us in that period.
TestSetGo supports assessment decisions; it does not make them. You remain responsible for decisions you take about a participant on the basis of a result.
11. Confidentiality
Each party will keep the other’s non-public information confidential and use it only to perform this agreement. This does not apply to information that is public through no breach, was already lawfully held, or must be disclosed by law.
12. Changes to these terms
We may update these terms. For material changes affecting a paid plan we will give at least 30 days’ notice by email or in-product. Continuing to use TestSetGo after a change takes effect means you accept the updated terms.
13. General
This agreement, the Acceptable Use Policy, the Data Processing Agreement and the Privacy Notice are the whole agreement between us about the service. You may not assign it without our consent; we may assign it to a group company or on a sale of the business.
If a term is held unenforceable, the rest continues in force. A delay in enforcing a right is not a waiver of it.
This agreement is governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
